Terms and conditions of service

By accessing and using Proavela, you agree to comply with these Terms of Service. If you disagree with any point, you should not use the platform. Proavela reserves the right to modify these terms at any time, notifying registered users of the changes.

"Platform" refers to the Proavela website and all its services. "Host" is the owner or manager of a boat who lists it for rental. "Guest" is the user who books and rents a boat. "Booking" is the rental agreement between Host and Guest facilitated by the platform. "Commission" is the percentage (12%) that Proavela charges for each booking.

To use certain features of Proavela, you need to create an account. You are responsible for maintaining the confidentiality of your credentials and all activity on your account. You must provide truthful and up-to-date information. Proavela reserves the right to suspend or delete accounts that breach these terms.

Proavela acts as an intermediary between Hosts and Guests. The rental contract is established directly between both parties. The platform facilitates the booking, payment and communication, but is not party to the rental contract. The Host is responsible for ensuring the boat complies with current regulations and is in suitable condition.

All payments are processed securely through Stripe. Proavela charges a 12% commission on the total amount of each booking. The Host receives the remaining 88% directly to their bank account via Stripe Connect. Displayed prices include the platform commission. The Host is responsible for declaring and paying taxes on their income.

Cancellations are governed by each boat's cancellation policy (Flexible, Moderate or Strict), visible before booking. The Guest can cancel from the "My bookings" section. The refund depends on the policy and days remaining until the start. If the Host cancels a confirmed booking, the Guest always receives a 100% refund.

The Host agrees to: • Provide accurate and up-to-date information about the boat. • Maintain the boat in good condition with all mandatory safety equipment. • Comply with maritime regulations and applicable local rules. • Respond to bookings and enquiries within a reasonable timeframe. • Hold the mandatory insurance for the boat.

The Guest agrees to: • Use the boat responsibly and follow the Host's or skipper's instructions. • Not exceed the maximum capacity indicated. • Return the boat in the same condition as received. • Report any incident or damage immediately. • Comply with navigation and maritime safety rules.

Proavela facilitates the connection between Hosts and Guests but is not responsible for the acts, omissions or breaches of either party. We do not guarantee the availability, quality or safety of boats. Use of the platform and rental services is at the users' own responsibility. Proavela is not liable for direct or indirect damages arising from the use of the platform.

All content on Proavela (design, code, text, logos, graphics) is the property of Proavela or its licensors. Reproduction, distribution or modification without prior authorisation is prohibited. Images and descriptions of boats are the responsibility of the respective Hosts.

Proavela reserves the right to modify these Terms of Service at any time. Modifications will be notified to registered users by email. Continued use of the platform after notification implies acceptance of the new terms.
